The e-shop www.takoy.com is an internet shop without a physical location; as a result, it is not possible to physically visit and view the goods or make in-person purchases.

Definitions:

"A "buyer" is an individual who makes purchases from the www.takoy.com online store.

"Order" is the completion of an electronic form that contains the buyer's contact information, a summary of the items they have ordered, the method of delivery and payment, and the total cost of the purchase.

"Goods" are all products displayed on the website www.takoy.com.


Ordering and contract conclusion

All orders placed through the online store are binding for both parties. By placing the order, the buyer confirms, that they have read these purchase and complaint conditions.

The condition for the validity of the electronic order is the true and total completion of all data and essentials required by the system during registration or during the execution of the order.

The purchase contract between the seller and the buyer is created by sending the order by the buyer customer and its receiveing by the seller.


Terms of Delivery

The seller undertakes:

- to deliver to the buyer the type and quantity of the ordered goods at the purchace price and under the payment conditions that apply on the day of sending the goods

- to deliver the goods to the buyer in an appropriate packaging to prevent the damage during transport


The seller is not responsible for:

- delayed delivery of goods caused by the transport company

- delayed delivery of goods as a result of the recipient's incorrect address

- the damage to the shipment caused by the transport company

- any inability to deliver goods due to a manufacturer's (supplier's) negligence as a result of any restriction or cancellation of distribution rights or other unforeseeable obstacles


The buyer undertakes:

- to accept delivery of the purchased items and inspect them for damage to the packaging.

- to pay the price for the goods in full and in accordance with the payment terms valid on the day of sending the order, by bank transfer, or on the day of delivery upon receipt of cash on the delivery order

In case, the buyer does not take possession of the products (as ordered), the seller retains the right to seek compensation for damages. If the customer does not accept the goods upon first delivery and requests re-delivery, he is obligated to pay the expenses of both the first delivery and the re-delivery of the goods.

Depending on the nature of the trade (quantity, transportation costs, distance, etc.), the seller has the right to ask the buyer to authorise the order in a credible manner, such as by phone or in writing. If the buyer declines the authorisation, the purchase is considered invalid by the operator.


Delivery time

Deliveries of the ordered goods are made as soon as possible, depending on the availability of products and the seller's operational capabilities. Orders of the goods in stock will usually be processed within 1 working day, the courier will deliver the shipment on the second working day, no later than 3 working days after we send them. In case of a change of delivery dates, the information will be listed on the page. If a different delivery time is specified for a specific product, we will inform you about the shipment of the goods. When paying via bank transfer, the order will be accepted only after receiving payment to our account.


Prices of goods

All of the prices listed on the website are final. The price of the goods does not include postage, we do not charge for packaging.

The proof of a sale is an invoice, which is sent to the e-mail address and serves both as a delivery and warranty list.


Order cancellation

The buyer is entitled to cancel the order without giving a reason within 2 hours of sending. (After 2 hours, the operator starts processing the order.) Send the order cancellation to our e-mail info@takoy.com, we will send you a confirmation of the order cancellation right away.


Return of goods - withdrawal policy

The goods must be returned to the address of the company's registered office (www.takoy.com, GOTANA, s.r.o., Duklianska 1379/19, 085 01 Bardejov, Slovakia) in the original packaging, complete, unused and undamaged.

The goods and services mentioned in points 6 and 7 of Act 102/2014 Coll. on consumer protection are the subject of the contract, which the consumer may not terminate.

Shipping costs when returning the goods are paid by the customer. We do not accept goods returned by cash on delivery. The price for the goods in total with the price of the lowest transport cost, which is stated on the website (this does not apply if the customer had free postage) will be returned to the customer immediately after checking the returned goods, by a postal order or to bank account, no later than 14 days from receiving. Returns of items that have been used, altered, or otherwise processed cannot be accepted within a 14-day period without providing a reason.

 

The possibility of returning the goods applies only to customers, who do not use the goods in the course of their business.


Return policy

We suggest that the buyer inspect the shipment on the spot to ensure that it is not damaged before accepting and paying for it. In case of extensive damage (torn packaging, deformation and other extensive damage), it is necessary to document the damage with the courier or refuse the shipment.

In the event of a complaint, the buyer will send the claimed goods to the address of the company's registered office. The package must be properly packed and contain the following items: the claimed goods, including accessories, a copy of the invoice, a description of the defect, and contact details of the buyer - return address, phone number, and e-mail. Send the goods either in the form of a package or as a letter. When sending goods by cash on delivery, this shipment will not be accepted. The claimed goods must be delivered clean and mechanically undamaged.


The warranty does not cover damage caused by:

- natural or excessive mechanical wear

- contamination of the goods or their parts

- exposing the goods to conditions that do not correspond to the temperature, dust, humidity, chemical, and mechanical influences of the environment in which the goods are normally used

- external influences, such as weather

- tampering with the goods by an unauthorized person (unprofessional repairs or modifications)

- mechanical damage - torn, cut, thermally damaged goods, goods damaged by careless disproportionate physical handling, intentional scratching of layers of goods, etc.

- natural disasters, violent damage, weather conditions, or operation in extreme and unusual conditions

In the event of an unjustified complaint, the goods will be returned to the buyer with the appropriate opinion.

Complaints of goods are handled by the seller without undue delay, but no later than 30 days from the date of the complaint by the buyer. By handling a justified complaint, the warranty period is extended by the duration of the complaint. If the complaint was settled by exchanging the goods for a new one within the statutory warranty period, then the warranty period will begin to run again from the date of settlement of the complaint. The seller will notify the buyer of the handling of the complaint either by telephone, text message or e-mail and will send the goods to the buyer's address at their own expense.
